These Terms of Service ("Terms") govern your access to and use of the conversation-engagement software, websites, and related services provided by CHATLA SOFTWARE SERVICES - FZCO ("chat·la", "we", "our"). By accessing or using any part of the Service you ("Customer", "you") agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
chat·la is a cloud platform that converts app events and user data into personalised, two-way conversations on WhatsApp, Facebook Messenger, and other channels. Features include but are not limited to campaign creation, AI-assisted message generation, analytics dashboards, and third-party integrations.
You agree not to:
chat·la and its licensors own all rights, title, and interest in the Service, including software, branding, and documentation. No rights are granted except as expressly set out in these Terms.
The Service integrates with platforms such as WhatsApp Business Platform, Facebook Messenger Bot API, and mobile-analytics providers. Your use of those services is governed by their respective terms, and chat·la is not responsible for disruptions or policy changes originating from third parties.
The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the Service will be uninterrupted, error-free, or that it will meet your performance requirements.
To the maximum extent permitted by law, in no event will chat·la, its officers, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or revenues, whether incurred directly or indirectly, even if we have been advised of the possibility of such damages. Our aggregate liability shall not exceed the total fees you paid to chat·la in the 12 months preceding the claim.
You agree to indemnify and hold harmless chat·la from any claim, demand, or loss arising out of your breach of these Terms or misuse of the Service.
These Terms are governed by the laws of the Dubai International Financial Centre (DIFC), UAE, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the DIFC Courts.
We may update these Terms from time to time. We will notify you via email or through the Service. Continued use after the effective date constitutes acceptance of the revised Terms.
